Ben spent close to 36 years as one of the most respected and successful Commercial Construction litigators and trial attorneys in the country. In late 2024, due to a significant swift surge in demand for his ADR services, Ben decided to retire from his construction advocacy practice and solely focus on ADR in the Commercial Construction space.

Ben’s stellar reputation in these fields and his dynamic temperament served as an organic driver to help serve his peers in these industries to resolve their disputes via arbitration or mediation.

 

Types Of Cases Arbitrated And Mediated:

The bulk of Ben’s Arbitrations and Mediations arise out of payment and/or performance disputes between Owners, General Contractors, Subcontractors and Design Professionals on large complicated construction projects including:


  • Military facilities;
  • Hospitals;
  • Mass transit systems;
  • Parking structures;
  • Luxury hotels;
  • Apartment and/or condominium complexes;
  • High-rise office buildings;
  • Retirement communities;
  • Retail centers;
  • Universities;
  • Industrial office complexes;
  • State and Federal Courthouses and other government facilities; and
  • Single family luxury residences.

The bulk of these disputes involve payment claims (contract breach, change orders, delay and productivity loss, mechanic’s lien, bonded stop notice, Miller Act) and often contain counterclaims for liquidated damages, failure to perform contracted scope claims, defective/non-conforming work, defective design, differing site conditions and other related components. Many of these ADR matters are multi-party actions with a multitude of issues to sort out, resolve or adjudicate.
